SECTION 3 – ARTWORK, PRODUCTS AND PRODUCT INFORMATION

We make every reasonable effort to ensure that product descriptions, photographs, dimensions, colours and other information displayed on our website are accurate.

However, artwork is a creative product and photographs displayed on a screen may not reproduce colours exactly as they appear in person.

Differences in colour caused by your device, monitor, screen settings, lighting or photographic conditions are not necessarily defects.

Original artworks may contain natural variations in texture, brushwork, finish and colour. Such characteristics form part of the individual nature of the artwork.

Where dimensions are provided, they are approximate unless otherwise stated.

We reserve the right to update product descriptions, discontinue products and make reasonable changes to products or their presentation where necessary.

SECTION 4 – PRICES AND AVAILABILITY

All prices are displayed in pounds sterling (£), unless otherwise stated.

Prices and availability may change from time to time.

Any change in price will not affect an order that we have already accepted, except where a genuine pricing error has occurred.

Where applicable, delivery charges will be displayed separately before you complete your purchase.

We reserve the right to limit quantities purchased where reasonably necessary.

Original artworks and limited-edition works may only be available in limited quantities. Once an original artwork has been sold, it may no longer be available for purchase.

SECTION 5 – ORDERS AND CONTRACT FORMATION

When you place an order through our website, you are making an offer to purchase the selected product or products.

Before completing your order, you should carefully check all information provided, including your selected product, quantity, delivery address and contact details.

After submitting your order, you will normally receive an order acknowledgement confirming that we have received your order.

Receipt of an order acknowledgement does not necessarily mean that the order has been accepted.

A contract will be formed when we accept your order or otherwise confirm that the product has been dispatched, as applicable.

If we cannot accept your order, we will notify you and refund any payment you have made.

We may cancel an order where, for example:

  • the product is unavailable;
  • there is a significant error in the product description or price;
  • we reasonably suspect fraudulent activity;
  • the order appears to have been placed for unauthorised resale; or
  • circumstances outside our reasonable control prevent us from fulfilling the order.

Where we cancel an order after payment has been taken, we will refund the amount paid for the cancelled product.

You agree to provide accurate and complete billing and contact information.

Where payment is processed through a third-party payment provider, your payment may be subject to that provider’s own terms and privacy policy.

We do not store full payment card details unless expressly stated otherwise.

SECTION 7 – DELIVERY

We aim to dispatch orders within the timeframe stated on the relevant product page or at checkout.

Delivery times are estimates unless a specific delivery date has been expressly agreed.

We will deliver goods without undue delay and, unless otherwise agreed, within 30 days of the contract being formed.

Delivery charges and available delivery options will be displayed during checkout.

You are responsible for ensuring that your delivery address is correct and complete.

If an order is returned because an incorrect address was provided, we may require payment of reasonable additional delivery costs before sending the order again.

Once your order has been dispatched, we may provide tracking information where available.

If your order arrives damaged, please contact us as soon as reasonably possible with your order number and photographs of the packaging and damaged item.

Nothing in these Terms affects your statutory rights concerning delivery or damaged, faulty or misdescribed goods.

SECTION 8 – INTERNATIONAL ORDERS

Where international delivery is available, additional customs duties, import taxes or other charges may apply depending on the destination.

Unless otherwise stated, any customs duties, import taxes or similar charges imposed by the destination country are the responsibility of the customer.

You are responsible for ensuring that products ordered from our website may lawfully be imported into your destination country.

SECTION 9 – RETURNS AND REFUNDS

Unless the goods are faulty, damaged or otherwise not in conformity with the contract, you may be responsible for the direct cost of returning the goods where you have been informed of this before purchase.

Where a statutory cancellation applies, we will refund the payments due to you in accordance with applicable law.

This will generally include the cost of standard delivery originally paid by you, but not any additional amount paid for an upgraded delivery service.

SECTION 10 – MADE-TO-ORDER AND PERSONALISED PRODUCTS

Certain products may be produced or prepared after you place an order.

The fact that a product is made after an order is placed does not, by itself, necessarily remove your statutory cancellation rights.

Where a product is genuinely made to your specifications or is clearly personalised for you, statutory cancellation rights may not apply, as permitted by UK law.

Where this applies, we will make the position clear before you complete your purchase.

This does not affect your statutory rights if a personalised or bespoke product is faulty, damaged, not as described or otherwise does not conform to the contract.

SECTION 11 – FAULTY, DAMAGED OR INCORRECT ORDERS

If you receive an item that is:

  • faulty;
  • incorrect;
  • materially different from its description; or
  • otherwise not of satisfactory quality,

Your statutory rights under applicable UK consumer law are not affected by this policy.

Depending on the circumstances, you may be entitled to a repair, replacement, price reduction or refund.

SECTION 12 – ORIGINAL ARTWORK

All original artwork remains the intellectual property of The Gele Painter unless expressly agreed otherwise in writing.

Purchasing an original artwork gives you ownership of the physical artwork.

It does not transfer copyright, reproduction rights or other intellectual property rights in the artwork to you.

You may display the artwork for personal use, but you may not reproduce, copy, scan, photograph for commercial reproduction, license, resell reproductions of or otherwise commercially exploit the artwork without our prior written permission.

We may photograph and reproduce images of sold artwork for our portfolio, website, exhibitions, social media, press, marketing and promotional purposes, unless otherwise agreed with you in writing.

SECTION 13 – PRINTS AND REPRODUCTIONS

Where prints or reproductions are available, they are sold as physical reproductions of original artwork.

Purchasing a print does not transfer copyright or reproduction rights to the purchaser.

Print colours may vary slightly from the original artwork and from the colours shown on your screen.

Where a print is described as limited edition, the edition size will be stated where applicable.

SECTION 14 – COMMISSIONS

Where we offer commissioned or bespoke artwork, the scope of the commission will be agreed with you before work begins.

The agreed details may include:

  • artwork size;
  • materials;
  • subject matter;
  • colour palette;
  • creative direction;
  • price;
  • payment arrangements; and
  • estimated completion timeframe.

A commission will only be confirmed once the relevant terms have been agreed and any required payment or deposit has been received.

Because commissioned artwork is individually created, the finished work may contain artistic interpretation and may not be an exact reproduction of reference photographs or examples.

Minor variations in colour, composition, texture or artistic interpretation are not necessarily defects.

If you request significant changes to an agreed commission after work has begun, additional charges or changes to the completion timeframe may apply. We will discuss these with you before proceeding where reasonably possible.

Where a commissioned artwork is genuinely made to your specifications or clearly personalised, your statutory cancellation rights may be restricted or excluded where permitted by law.

SECTION 15 – INTELLECTUAL PROPERTY

All intellectual property rights in the website and its content belong to The Gele Painter or the relevant rights holder.

This includes, without limitation:

  • original artwork;
  • artwork images;
  • photographs;
  • illustrations;
  • written content;
  • logos;
  • branding;
  • graphics;
  • website design; and
  • other creative materials.

You may view and use the website for your personal, non-commercial use.

If you voluntarily submit photographs, images, comments, reviews, ideas, suggestions or other content to us, you confirm that you have the necessary rights to submit that material.

You must not submit material that:

  • contains malicious software; or
  • otherwise breaches applicable law.

Where you submit content such as a review or testimonial, you grant us permission to use that content for the purposes of operating, promoting and marketing The Gele Painter, subject to applicable privacy law.

Nothing in these Terms of Service is intended to remove or restrict any rights you have under UK consumer law.

Where you purchase goods online as a consumer, you may have a statutory right to cancel within 14 days of receiving the goods, subject to legal exceptions. Where that right applies, you do not need to give a reason for cancelling.
